Levy's defamation suit against four-term Sheriff Don Smith next week in state Supreme Court in Carmel. Jury selection was conducted last week.
Smith was investigating Levy's personal trainer Alexander Hossu for raping a 13-year-old girl. Hossu was later charged and Smith accused Levy of interfering in the investigation and said Hossu lived with Levy in a press release. Hossu was later acquitted and Levy recused him from the case.
Smith, who previously countersued Levy, has rejected any talks of a settlement. Smith claims the press release was simply his opinion, according to LoHud.
Hossu was an overnight guest at Levy's Southeast home while he dated Levy's nanny, according to LoHud. While Hossu listed Levy's address on his driver's license, he lived at Clocktower Commons in Southeast when he was arrested.
In 2015, Levy was defeated for re-election by Bob Tendy.
Hossu has filed a $45 million lawsuit against the county, Smith, lead investigator Steve Tricinelli and senior investigator Patrick Castaldo.
