Silver’s resignation is effective at 11:59 p.m. Monday, but Silver is retaining his Assembly seat, according to Newsday.

Silver, a 70-year-old Lower East Side resident, has been accused of receiving $4 million in kickbacks; if he is convicted, the 21-year senator could face up to 100 years in prison, Newsday reported.
